New changes in Evidence Act, IPC, Crpc

In order to bring changes in criminal justice system Union home minister Amit shah has introduced 3 bills in Parliament today. 

To ammend the old British made laws, after consultations with number of experts indian parliament has brought new bills on   Crpc, Evidence Act and Indian penal code.

This bills talks about extension  of  Punishment in Rape, mob lynching, offences with minor/children,  etc.

This bill talks about repealing of Sedition laws in india which was topic of debate  from many years. 

And digitalization the court proceedings.

What is new in these bills

CRPC (criminal procedure code)

Now Crpc will contain 533 sections.

160 sections of Crpc Replaced 

9 new sections are added. 

And 9 sections deleted. 

Indian penal code 

IPC at present contain 511 sections but 

In new IPC there will be 356 sections 

175 sections of IPC amended. 

8 new sections Added in new IPC

22 sections deleted/ removed. 

Evidence act 

Earlier (at present ) evidence act contains 166 sections,

Now in new law, it will contain 170 sections.

23 sections are amended.  

1 new section added. 

5sections from act removed. 

Digitization

In order to digitalize the court proceeding, parliament has brought provisions with this regard also. Till now in lower courts only accuse appears through online mode from jails,  now in new module of the criminal justice system digitization will be an important part of court proceedings.

Now whole trial can be done through online mode including recoding of witnesses. 

Union home minister while addressing in the parliament said, this law will help in  achieving conviction rate of more than 90%.

This law has mentioned about Compulsory visit  of forensic team on crime scene, where punishment is more then 7 years. 

Now, police while making arrest has to give certificate of arrest to family members of arrestee,  it is compulsory for police to inform family members through online mode as well as through physical mode after making arrest of person. This will definitely reduce the habeas corpus petitions in higher courts. 

Summary trails 

Limit of Summary trails has increased, now offences with punishment upto 3 years can be concluded quickly through summary trails (earlier the limit was 2 years).

Limit for filling challan in court

Now it is compulsion on police to file Challan within 90 days, as we know many cases are pending in court just because police does not file Chargesheet for many years now under new law Police has to submit challan with in 90 days, discretion has granted to court for exceeding limit to more 90 days.

Making Sexual relations with wrong/fake identity is punishable according to new bill.

Punishment in Rape

In young rape cases punishment has increased to 20 years or Life imprisonment. 

In Rape with less then 18 years old, punishment of Death sentence can be given. 

Mob Lynching 

We have witnesses increasing cases of mob lynching, there was no specific law on it but now punishment for mob lynching has mentioned, 7 years of imprisonment,  Death sentence, can be given in these offences. 

Sedition law 

Law which was in debate from many years, sedition law introduced by britishers in India for suppressing the   freedom movements was still in existence in indian penal code. Now finally that law will be repealed under new amendment.
